Please read these terms and conditions carefully before booking accommodation, services, or events at High Bank Himalayan Retreat.

Terms and Conditions of Service

These Terms and Conditions govern your use of High Bank Himalayan Retreat's services, including accommodation bookings, adventure activities, event planning, and website usage. By making a booking or using our services, you agree to comply with these terms.

Effective Date: These terms are effective as of February 7, 2026 and apply to all bookings and services provided by High Bank Himalayan Retreat.

Acceptance of Terms

By accessing our website, booking accommodation, services, or events with High Bank Himalayan Retreat, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms apply to all bookings made directly through our website, WhatsApp, phone, email, or in-person at our resort in Shivpuri, Rishikesh.

Booking Terms and Conditions

Reservation Process

  • Bookings can be made via WhatsApp, phone (+91 98976 54321), email, or our website contact form
  • All bookings are subject to availability and confirmation by High Bank Himalayan Retreat
  • A booking is confirmed only after receipt of advance payment (50% of total amount)
  • Booking confirmation will be sent via WhatsApp, email, or SMS
  • Guests must provide accurate information during booking (name, contact details, check-in/out dates, number of guests)

Check-in and Check-out

  • Standard check-in time: 12:00 PM (noon)
  • Standard check-out time: 11:00 AM
  • Early check-in and late check-out are subject to availability and may incur additional charges
  • Guests must present valid government-issued ID proof at check-in
  • All guests must be registered at the time of check-in

Room Occupancy

  • Room rates are based on double occupancy unless otherwise specified
  • Extra person charges apply for additional guests beyond the standard occupancy
  • Children below 6 years: Complimentary (subject to room capacity)
  • Children 7-10 years: 50% charges may apply
  • Maximum occupancy limits must be strictly adhered to for safety and comfort

Payment Terms

  • Advance payment: 50% required at the time of booking confirmation
  • Balance payment: Due at check-in or as per agreed payment schedule
  • Accepted payment methods: UPI, Bank Transfer, Cash (Indian Rupees only)
  • All prices are in Indian Rupees (INR) and inclusive of applicable taxes
  • GST (18%) is applicable on all bookings as per Indian tax regulations
  • Payment receipts will be provided for all transactions

Cancellation and Refund Policy

Accommodation Cancellations

  • Cancellations made 30+ days before check-in: 90% refund of advance payment
  • Cancellations made 15-29 days before check-in: 75% refund of advance payment
  • Cancellations made 7-14 days before check-in: 50% refund of advance payment
  • Cancellations made less than 7 days before check-in: No refund
  • No-show (failure to arrive on check-in date): No refund
  • Refunds will be processed within 7-14 business days to the original payment method

Modification Policy

  • Date modifications are subject to availability and may incur additional charges
  • Modifications requested 15+ days before check-in: No charges (subject to availability)
  • Modifications requested 7-14 days before check-in: 20% modification fee may apply
  • Modifications requested less than 7 days before check-in: 50% modification fee may apply
  • Room category upgrades: Additional charges apply based on rate difference
  • Downgrades: No refund for rate difference

Adventure Services Cancellations

  • Full refund for cancellations made 48+ hours before activity
  • 50% refund for cancellations made 24-48 hours before activity
  • No refund for cancellations made less than 24 hours before activity
  • Weather-related cancellations: Full refund or reschedule option available
  • Medical emergencies: Refund or reschedule subject to documentation

Event Bookings Cancellations

  • Event cancellations (weddings, celebrations): Subject to separate terms as per event contract
  • Advance payments for events are generally non-refundable
  • Refund eligibility depends on cancellation timeline and event type
  • Please refer to your specific event booking agreement for detailed terms

Guest Responsibilities and Conduct

Guest Conduct

  • Guests must respect other guests, staff, and resort property
  • Noise levels must be maintained, especially during quiet hours (10 PM - 7 AM)
  • Smoking is prohibited in rooms and indoor areas (designated smoking areas available)
  • Illegal activities are strictly prohibited on resort premises
  • Guests are responsible for any damage to resort property
  • Pets are not allowed unless prior written permission is obtained

Safety and Security

  • Guests must follow all safety instructions provided by resort staff
  • Adventure activities (rafting, trekking, bungy jumping) require signing liability waivers
  • Guests participate in activities at their own risk
  • Children must be supervised by adults at all times
  • Use of swimming pool and recreational facilities is at guest's own risk
  • Guests must secure their valuables (safety lockers available in premium rooms)

Property Damage

  • Guests are liable for any damage caused to resort property, fixtures, or equipment
  • Damage charges will be assessed and charged to the guest's account
  • Excessive cleaning charges may apply for rooms left in unacceptable condition
  • Lost keys or access cards: Replacement charges apply

Accommodation Terms

Room Amenities

  • All rooms include: WiFi, parking, breakfast & dinner (MAP), tea/coffee facilities
  • Premium Suites include: All meals (AP), additional amenities as specified
  • Room amenities are subject to availability and may vary by room category
  • Additional services (laundry, spa, etc.) are chargeable

Meals

  • Breakfast and dinner are included in room rates (MAP - Modified American Plan)
  • Premium Suites include all three meals (AP - American Plan)
  • Meal timings: Breakfast (8:00 AM - 10:00 AM), Dinner (7:00 PM - 10:00 PM)
  • Special dietary requirements must be communicated at least 24 hours in advance
  • Outside food and beverages may be restricted in certain areas

Adventure Activities

  • Basic activities (nature walks, bonfire) are complimentary
  • Adventure activities (rafting, trekking, bungy jumping) are chargeable
  • Activity bookings are subject to weather conditions and availability
  • Minimum age and fitness requirements apply for certain activities
  • Safety equipment is provided for all adventure activities
  • Guests must follow guide instructions during activities

Group Bookings and Events

Group Bookings

  • Special rates available for groups of 10+ people
  • Group bookings require advance confirmation and payment schedule
  • Group cancellation policies may differ from individual bookings
  • Custom packages available for corporate retreats, school trips, and large groups

Event Bookings

  • Events (weddings, celebrations, corporate events) require separate contracts
  • Event bookings include specific terms regarding venue, catering, decoration, and services
  • Advance payment schedules vary for events (typically 25% booking, 25% one month before, etc.)
  • Event cancellation terms are specified in individual event contracts
  • External vendors (decorators, DJs) may have separate agreements

Limitation of Liability

General Liability

  • High Bank Himalayan Retreat is not liable for loss, theft, or damage to guest property
  • Guests are advised to use safety lockers for valuables
  • The resort is not responsible for personal injury except due to proven negligence
  • Adventure activities involve inherent risks; guests participate at their own risk

Force Majeure

  • We are not liable for failure to perform due to circumstances beyond our control
  • Force majeure events include: natural disasters, pandemics, government restrictions, strikes, etc.
  • In such cases, refunds or rescheduling will be handled on a case-by-case basis
  • Guests are advised to obtain travel insurance

Website and Booking System

  • We strive for accuracy but do not guarantee error-free website information
  • Pricing errors may occur; we reserve the right to correct pricing and cancel erroneous bookings
  • Website availability and functionality are not guaranteed
  • We are not responsible for third-party booking platforms or their terms

Special Policies

Holi Celebration Package

  • Package valid only for Holi festival dates
  • Bookings are non-refundable and non-transferable
  • Only organic colors provided by resort are permitted
  • Outside colors, chemical colors, and water balloons are strictly prohibited
  • Management reserves right to alter activities due to weather or operational reasons

Destination Wedding Package

  • Package designed for specified number of guests (typically 60, expandable on request)
  • Payment stages: 25% booking, 25% one month before, 25% one week before, 25% at checkout
  • Children policy: Below 6 years complimentary, 7-10 years 50% charges
  • Decoration and DJ services managed between client and service providers
  • 18% GST applicable; 10% discount available on package price

Environmental Policy

  • We are an eco-resort committed to sustainable practices
  • Guests are encouraged to conserve water and electricity
  • Waste segregation and recycling practices must be followed
  • Plastic usage is minimized; reusable alternatives are provided

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of India and the state of Uttarakhand. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Rishikesh, Uttarakhand, India.

By booking with High Bank Himalayan Retreat, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
